This privacy policy describes ASA - the Swiss Arbitration Association (“ASA”)’s current policies and practices with regard to personal data collected by ASA through its website, www.arbitration-ch.org, apps for mobile online platforms (hereinafter referred to collectively as “ASA’s website and apps”) and through physical data collection through registration at events.  The term "personal data" refers to personally identifiable information about you, such as your name, birth date, e-mail address or mailing address, and any other information that is identified with you personally, including your individual health information.

Purposes behind ASA’s Data Processing

ASA uses the personal data information you provide to answer the query you will have posted through the site.  ASA also uses this information to help us improve the content and functionality of our website, to better understand our clients and markets, and to improve our services.  ASA may use this information to contact you in the future to tell you about products or services we believe will be of interest to you.

The Type of Personal Data ASA Collects and ASA’s Methods of Data Collection

ASA collects personal information you voluntarily give us when you use our sites, register for our events, or become a member.  For example, you may use the website site to contact ASA with questions and requests.  When you fill out a form on our website, you may provide your name and other contact information, including your company’s name, your e-mail address, and your mailing address or the mailing address of your company or other personal information.  ASA collects data on our subscribers’ interactions with our newsletters including which links subscribers’ click and whether they have opened the e-mail.

Member Profiles

You expressly consent that any information provided as part of a profile meant to be published on the ASA website and/or app is intended for broad public dissemination.

Your Rights

You may, at any time, request to verify, access, rectify, delete, transfer and object to the use of your data, as well as request the limitation of such use of your data. To do so, send us an email at the following address: info@arbitration-ch.org.

ASA will then make every reasonable effort to take the necessary action as soon as possible.  You might also withdraw consent of ASA using your data by clicking the unsubscribe button located at the bottom of the e-mails we send or by contacting us.

If you feel that your privacy rights have been violated, you have a right to lodge a complaint with the applicable Data Protection Authority.

How long does ASA store your data

ASA will keep your data as long as it is necessary to achieve its purpose outlined above or when we continue to have a valid e-mail address for you.  If your data no longer serve our purposes, it will be removed.

Disclosure of Your Personal Data

ASA may share some or all of the personal data collected through this website with its subcontractors, who use this data in accordance with this Privacy Policy to achieve the purposes for which you delivered to us your personal data. In addition, there may be some other, limited circumstances in which ASA may share or transfer the personal data in our databases, for example, to comply with a legal requirement, for the administration of justice, to protect your vital interests, or in the event of a reorganization, dissolution, or similar event. While no method of data transmission is guaranteed against unlawful third party interception or other misuses, ASA uses commercially reasonable efforts to ensure the protection of your data including industry-standard encryption and offline security methods in our physical facilities.

Anonymous Data Collected Through ASA Website and Apps

In addition to the information you provide when you use our website and apps, ASA uses technology to collect anonymous information about the use of our website and apps. For example, we use technology to track how many visitors access our website or apps, the date and time of their visit, the length of their stay, and which pages they view. We also use technology to determine which web browsers or mobile platforms our visitors use and the address from which they accessed our sites (for example, if they connected to the ASA website by clicking on an ad).

This technology does not identify you personally. It merely enables us to compile statistics about our visitors and their use of our sites and apps. ASA uses this anonymous data and shares it with third parties to improve the content and functionality of our website, to better understand our clients and markets, and to improve our services.

Notification of Changes to This Policy

ASA is continually improving and adding new functionality and features to its website and apps as well as improving and adding to our existing products, services, and programs. Because of these ongoing changes, changes in the law and the changing nature of technology, ASA’s data practices will change from time to time. If and when our data practices change, ASA will post the changes on our website to notify you of the changes. We encourage you to check the website frequently.
